Terms of Service

These Terms of Service (the "Agreement") are made between KonumX (Adem TÜRK) ("KonumX", "we"), the operator of the KonumX service, and the natural or legal person subscribing to the service ("User", "you").

Service: the web-based platform operated by KonumX that produces narrated real-estate promotional videos from listing details. Office: the real-estate office/brand subscribing to the service. Office Manager: the user who opens the account on behalf of the office and manages its team. Sub-User: a team member added by the office manager. Subscription: the periodic usage right tied to the selected plan. Video Credit: a non-expiring usage right, purchased independently of a subscription, that entitles the holder to create one new video and download it watermark-free, or to unlock the watermark-free copy of an existing video. Content: photos, logos, listing details uploaded by the user and the videos produced.

By creating an account or using the service you are deemed to have accepted this Agreement and the Personal Data Protection (KVKK) Notice.

KonumX produces promotional videos using the listing details you enter, cadastral (parcel) queries, map/satellite imagery and 3D terrain/city models. The narration is built from templates; values such as price, floor area and distances come from the data you enter or from map/TKGM measurements. Generative AI is not used to invent figures or facts.

The service is provided "as is". KonumX reserves the right to improve, change or remove features, and to temporarily suspend the service for maintenance and improvements.

You agree to provide accurate, current and complete information during registration. You are responsible for keeping your account credentials confidential and for all activity carried out through your account.

The Office Manager is responsible for ensuring that the Sub-Users they add use the service in accordance with this Agreement. You must notify us immediately if you become aware of any unauthorised access.

You represent and warrant that you hold the rights to use and process all content you upload to the service (photos, logos, agent images, listing text, contact details) and that it does not infringe the copyright, personality or other rights of third parties.

Entering misleading or false listing information, promoting another person's property without authorisation, and producing unlawful, defamatory or public-order-violating content are prohibited. You are solely responsible for the content and publication of the videos you produce.

All claims, damages and legal liability arising from content that violates this clause belong to the user; KonumX reserves the right to remove such content and suspend the account.

All rights in the KonumX software, design, brand and all of its components belong to KonumX. You may not copy them, reverse-engineer them or use them without permission.

You have the right to use the videos you produce to promote your own listings. The map/satellite/3D layers in the video are subject to the licences of the respective providers, and provider attributions may not be removed (see Section 6).

Map and imagery data used in the videos come from providers such as OpenStreetMap contributors, the Turkish General Directorate of Land Registry and Cadastre (TKGM) and Google. Those providers' terms of use apply, and the relevant attributions are automatically included in the videos and may not be removed.

TKGM parcel boundaries and area figures are for visual/informational purposes only; they do not replace official land-registry records, survey sketches or legal documents. Always consult official sources for definitive information.

The service is a periodic subscription tied to the selected plan (Starter, Professional, Premium). Each plan's monthly video and user limits are stated on the plans page. Campaigns and discounts are launch-period specific and time-limited; the applicable price and discount for each order is clearly shown on the registration/checkout screen. Discount rates may be updated over time and are not permanently guaranteed for future periods.

For users who do not want a subscription, pay-per-video credits are offered: 1 credit entitles you to create 1 new video and download it watermark-free, or to unlock the watermark-free copy of an existing video. Credits never expire and are assigned to the office account.

During the launch/early-access period, account access may be granted before the secure payment infrastructure is activated. Once payments are live, you are charged the discounted price shown at registration. Payments are collected through the PayTR secure payment infrastructure; card details are not stored on KonumX systems.

The Distance Sales Agreement and the Cancellation/Refund Policy govern pricing, cancellation and refunds.

The accuracy of the information in a produced video depends on the data entered by the user. KonumX cannot be held liable for damages arising from incorrect/incomplete user input or from deviations in third-party map/parcel data.

To the maximum extent permitted by applicable law, KonumX is not liable for indirect, incidental or consequential damages. KonumX's total liability is limited to the subscription fee you paid for the relevant period.

If you breach this Agreement, KonumX may suspend or terminate your account without prior notice. You may cancel your subscription at any time; cancellation takes effect under the Cancellation/Refund Policy.

In the event of termination, we endeavour to provide access for a reasonable period so that you can download the videos you have produced.

KonumX may update this Agreement. Material changes are announced through reasonable means (site notice or email). Continuing to use the service after a change means you accept the updated terms.

In circumstances beyond the parties' reasonable control — such as natural disaster, fire, epidemic, cyber-attack, infrastructure or communication outage, or decisions of public authorities — performance of obligations is suspended for the duration of the force majeure. If it lasts longer than thirty days, either party may terminate the Agreement.

If any provision of this Agreement is held invalid, the validity of the remaining provisions is unaffected. KonumX may assign its rights and obligations under this Agreement to a third party; the User may not assign without KonumX's written consent.

Together with the KVKK Notice, the Distance Sales Agreement and the Cancellation/Refund Policy, this Agreement constitutes the entire understanding between the parties and supersedes prior statements on the subject.

This Agreement is governed by and construed under the laws of the Republic of Türkiye. For consumer transactions, the Consumer Arbitration Committees and Consumer Courts at the consumer's place of residence are competent within the monetary limits set by legislation; for merchants and legal-entity users, the courts and enforcement offices at KonumX's place of business are competent.
